The Humane Society of the United States v. Gutierrez
On October 31, 2010, we challenged the National Marine Fisheries Service’s continued operation of four Northeastern fisheries in the face of violations of the ESA and the Marine Mammal Protection Act (“MMPA”). In particular, we alleged that the agency was required to reinitiate Section 7 consultation in light of new deaths and entanglements of endangered large whales that undermine key assumptions in the agency’s 2010 biological opinions, and we allege that the agency is illegally causing take in violation of ESA Section 9 and the MMPA by authorizing a fishery it knows will cause take without required ESA and MMPA authorizations. This case is filed in the federal district court for Massachusetts.
