Winter v. Natural Resources Defense Council
Amicus brief filed in Winter v. NRDC, the “Navy sonar” case brought before the U.S. Supreme Court. The brief argues for the need for injunctive relief to be available under the National Environmental Policy Act without a prohibitively high showing of certainty regarding the potential for environmental harm from a proposed federal action. It also disputes the Navy’s contention that an injunction can only be warranted by harms to a species’ population, rather than injuries or death of individual animals, and challenges’ the Navy’s contention that its environmental assessment was tantamount to a full EIS.
